Acceptable Use Policy
Effective September 27, 2026
CapSend is for organizations asking people for videos they are glad to make: a greeting from a leader, a customer story, a speaker introduction. This policy sets out what you may not do with the Service. It applies to everyone who uses CapSend, including customers, their members, and recipients, and it is part of our Terms of Service.
Prohibited content
Don't request, record, upload, send, or share content that includes:
- Child sexual abuse or exploitation. Any content that sexualizes or exploits minors. We remove it, report it to the National Center for Missing and Exploited Children (NCMEC), and terminate the account.
- Sexual content or nudity, including sexually explicit or suggestive material.
- Non-consensual intimate imagery, including intimate images shared without consent and sexual deepfakes of real people.
- Violence and threats, including threats against people or groups, glorification of violence, and content that supports terrorism or violent extremism.
- Hate and harassment, including attacks on people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or similar characteristics, and bullying or intimidation of individuals.
- Promotion of self-harm, including encouraging suicide, self-injury, or eating disorders.
- Illegal goods and activities, including fraud, the sale of illegal drugs or weapons, and any other content that breaks the law.
- Intellectual property infringement, including music, video, or other material you don't have the right to use.
- Privacy violations, including another person's private information shared without permission, or recordings of people who haven't agreed to be recorded.
Prohibited requests and messaging
Don't use CapSend to:
- Ask anyone, of any age, for sexual, nude, intimate, or "private" videos.
- Request a video from anyone under 18 without first obtaining verifiable consent from their parent or guardian.
- Groom, sextort, or otherwise pressure anyone into recording.
- Phish, impersonate a person, or send requests on behalf of an organization you don't represent.
- Send spam, or invite people from purchased, rented, or scraped lists, or people who haven't agreed to hear from you.
- Send text messages about sex, hate, alcohol, firearms, or tobacco, or other content that mobile carriers prohibit.
- Harass, threaten, or repeatedly contact someone who has asked you to stop.
- Record people covertly, or ask a recipient to record other people who haven't agreed to it.
- Create fake or misleading testimonials, including scripting someone to claim experiences they didn't have, paying for reviews without disclosure, or presenting employees as independent customers.
Sensitive information
CapSend is not built to hold highly sensitive data. Don't put any of the following in requests, scripts, notes, or recordings:
- Protected health information subject to HIPAA. This requires a signed Business Associate Agreement, and we don't currently offer one.
- Government identification numbers, such as Social Security, passport, or driver's license numbers.
- Payment card numbers or bank account details.
- Passwords or other login credentials.
Security and platform abuse
Don't:
- Probe, scan, or test the vulnerability of the Service, or get around authentication, rate limits, or plan limits.
- Access accounts, requests, recordings, or links that aren't yours, or try to guess link tokens.
- Upload malware or files designed to harm devices or systems.
- Overload the Service, scrape it, or access it by automated means other than the interfaces we provide.
- Use CapSend to host or distribute files unrelated to video requests.
If you have found a security vulnerability, please report it to abuse@capsend.app and give us a reasonable chance to fix it before disclosing it.
How we enforce this policy
We don't monitor all content, but we use automated tools and human review to find violations. Request text is screened before invitations are sent, and sampled frames from recordings may be checked by an automated image-moderation service. Automated tools flag content, and a person reviews it before we act on an account. We also act on reports from recipients, customers, and the public.
Depending on how serious the violation is, we may:
- Remove or disable content, or hold a recording from being shared while we review it.
- Pause a request or stop invitations from being sent.
- Restrict features, such as text messaging or open links.
- Suspend or terminate the account.
- Report content to NCMEC or law enforcement, and preserve it as the law requires.
When we take action, we tell the affected customer what we did, which rule it was based on, whether automated tools were involved, and how to appeal, unless the law or a risk of harm prevents it. To appeal, write to legal@capsend.app with the details. A person who was not involved in the original decision will review it where possible, and we will tell you the outcome. If we learn of content that suggests a threat to someone's life or safety, we will alert the relevant authorities.
How to report a problem
Anyone can report a request, recording, or share link, including recipients and people without an account:
- Use our report form, or email abuse@capsend.app.
- For copyright complaints, email copyright@capsend.app and follow the notice steps in our Terms of Service.
- If you believe a child is in immediate danger, contact local law enforcement first. You can also report to NCMEC's CyberTipline.
Please include the link or the name of the organization, what the problem is, and how to reach you if you would like a reply. Here is what happens next:
- We confirm that we received your report.
- We review it and decide what to do, promptly and with the most urgent reports first.
- We tell you our decision, and we tell the affected customer what action we took and how to appeal.
- Either of you can ask us to reconsider by writing to legal@capsend.app.
Intimate images. If an intimate image or video of you was shared through CapSend without your consent, including a sexual deepfake, report it through the form or at abuse@capsend.app. We will remove it within 48 hours of receiving a valid request and make reasonable efforts to remove copies we find.
Authorities and users in the European Union. Our single point of contact for authorities and users under the EU Digital Services Act is legal@capsend.app. We accept messages in English.
Changes to this policy
We may update this policy as new risks appear. We will tell organization Owners by email about material changes. Questions about this policy can go to legal@capsend.app.
